Sans un consentement \u00e9clair\u00e9 (Informed Consent), m\u00eame une intervention r\u00e9alis\u00e9e dans les r\u00e8gles de l\u2019art constitue, d\u2019un point de vue purement juridique, une atteinte \u00e0 l\u2019int\u00e9grit\u00e9 physique. Le patient doit avoir suffisamment confiance pour \u00eatre en mesure de poser toutes les questions n\u00e9cessaires. Les r\u00e9ponses fournies par le m\u00e9decin doivent \u00eatre pleinement satisfaisantes.  <\/p>\n\t\t\n<\/div>\n<div class=\"elementor-element elementor-element-502b344 e-con e-atomic-element e-div-block-base content-768 padding-0 content-center e-502b344-bc392b5 \" data-id=\"502b344\" data-element_type=\"e-div-block\" data-e-type=\"e-div-block\" data-interaction-id=\"502b344\" data-e-type=\"e-div-block\" data-id=\"502b344\">\n    \t\t\t<h3 data-interaction-id=\"364721a\" class=\"heading-jakarta-30-600 e-heading-base\" data-e-type=\"widget\" data-id=\"364721a\">Le d\u00e9roulement g\u00e9n\u00e9ral de l\u2019information avant une intervention<\/h3>\n\t\t\t\t\t<p class=\"paragraph-inter-18-400 e-paragraph-base\" data-interaction-id=\"8f02bea\" data-e-type=\"widget\" data-id=\"8f02bea\">Une information juridiquement valable doit r\u00e9pondre \u00e0 certains crit\u00e8res de forme et de contenu :<\/p>\n\t\t\t\t<div class=\"elementor-element elementor-element-5e9ceee elementor-widget elementor-widget-text-editor\" data-id=\"5e9ceee\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li><strong style=\"color: #122b49; font-weight: 600;\">L\u2019entretien personnel :<\/strong><br\/>L\u2019information doit en principe faire l\u2019objet d\u2019un entretien personnel avec le m\u00e9decin traitant (ou un rempla\u00e7ant qualifi\u00e9). La simple remise de fiches d\u2019information ou de vid\u00e9os ne suffit pas, celles-ci ne servant que de support. <\/li><li><strong style=\"color: #122b49; font-weight: 600;\">Le d\u00e9lai raisonnable :<\/strong><br\/>Le patient doit \u00eatre inform\u00e9 \u00e0 temps \u2013 c\u2019est-\u00e0-dire qu\u2019il doit disposer d\u2019un temps de r\u00e9flexion suffisant pour peser le pour et le contre. Pour les interventions \u00e9lectives (planifi\u00e9es), cela devrait se faire au moins un jour avant l\u2019intervention. Id\u00e9alement encore plus t\u00f4t.  <\/li><li><strong style=\"color: #122b49; font-weight: 600;\">La compr\u00e9hensibilit\u00e9 :<\/strong><br\/>L\u2019information doit \u00eatre donn\u00e9e dans un langage compr\u00e9hensible pour le profane (renonciation aux termes m\u00e9dicaux techniques incompr\u00e9hensibles). Diagnostic et pertinence (information sur l\u2019indication)<\/h4>\n\t\t\t\t\t<p class=\"paragraph-inter-18-400 e-paragraph-base\" data-interaction-id=\"e47e25c\" data-e-type=\"widget\" data-id=\"0mgiaye\">Il faut faire comprendre au patient quelle est la maladie ou le diagnostic pos\u00e9 et pourquoi la mesure propos\u00e9e (qu\u2019il s\u2019agisse d\u2019une op\u00e9ration, d\u2019une th\u00e9rapie ou d\u2019une m\u00e9dication) est m\u00e9dicalement judicieuse et n\u00e9cessaire. Alternatives (information sur les alternatives)<\/h4>\n\t\t\t\t\t<p class=\"paragraph-inter-18-400 e-paragraph-base\" data-interaction-id=\"e47e25c\" data-e-type=\"widget\" data-id=\"14y68wb\">Existe-t-il d\u2019autres m\u00e9thodes m\u00e9dicalement judicieuses qui m\u00e8nent \u00e0 un objectif similaire, mais qui comportent d\u2019autres risques ou contraintes ? Le m\u00e9decin ne doit pas seulement vanter sa m\u00e9thode pr\u00e9f\u00e9r\u00e9e, mais doit pr\u00e9senter \u00e9quitablement les v\u00e9ritables alternatives (par ex. th\u00e9rapie conservatrice vs op\u00e9ratoire). <\/p>\n\t\t\n<\/div>\n\n\t\t\t\t\t<div class=\"elementor-element elementor-element-0k5ou34 e-con e-atomic-element e-div-block-base e-48528ce-ffbcb55 padding-20 padding-24 \" data-id=\"0k5ou34\" data-element_type=\"e-div-block\" data-e-type=\"e-div-block\" data-interaction-id=\"48528ce\" data-e-type=\"e-div-block\" data-id=\"0k5ou34\">\n    \t\t\t<h4 data-interaction-id=\"12045bd\" class=\"heading-jakarta-18-700 e-heading-base\" data-e-type=\"widget\" data-id=\"079siqj\">4.
